1. USER REPRESENTATIONS
By using the Site/using the discord server/purchase an upgrade, you represent and warrant that:
(1) all registration information you submit will be true, accurate, current, and complete;
(2) you will maintain the accuracy of such information and promptly update such registration information as necessary;
(3) you have the legal capacity and you agree to comply with these Terms of Service;
(4) you will not access the Site/discord server/purchase an upgrade through automated or non-human means, whether through a bot, script, or otherwise;
(5) you will not use the Site/discord server/purchase an upgrade for any illegal or unauthorized purpose;
(6) your use of the Site/discord server/purchase an upgrade will not violate any applicable law or regulation.
If you provide any information that is untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate your account/subscription/ban and refuse any and all current or future use of the Site/discord server/purchase an upgrade (or any portion thereof).
2. USER REGISTRATION
You will have to register on the Site to be able to get paid features. You agree to keep your password confidential and will be responsible for all use of your account and password. We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable.
3. PROHIBITED ACTIVITIES
You may not access or use the Site/discord server/upgrade for any purpose other than that for which we make the Site/discord server/upgrade available. The Site/discord server/upgrade may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us.
As a user of the Site / paid upgrade user / MONCHARTS discord server user, you agree not to:
- systematically retrieve data or other content from the Site/discord server/upgrade to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us.
- make any unauthorized use of the Site/discord server/upgrade, including collecting user names and/or email addresses by electronic or other means for the purpose of sending unsolicited email, or creating user accounts by automated means or under false pretenses. Any person that will share any paid features/content published by MOONCHARTS outside the dedicated sections (non VIP/APPRENTICE/INVESTOR places), will have their subscription cancelled, without refund and banned from the website & discord server.
- use a buying agent or purchasing agent to make purchases on the Site.
- use the Site/discord server/upgrade to advertise or offer to sell goods and services.
- circumvent, disable, or otherwise interfere with security-related features of the Site/discord server/upgrade, including features that prevent or restrict the use or copying of any Content or enforce limitations on the use of the Site and/or the Content contained therein.
- engage in unauthorized framing.
- make improper use of our support services or submit false reports of abuse or misconduct.
- engage in any automated use of the system, such as using scripts to send comments or messages, or using any data mining, robots, or similar data gathering and extraction tools.
- interfere with, disrupt, or create an undue burden on the Site/discord server/upgrade or the networks or services connected to the Site/discord server/upgrade.
- attempt to impersonate another user or person or use the username of another user.
- sell or otherwise transfer your profile.
- use any information obtained from the Site/discord server/upgrade in order to harass, abuse, or harm another person.
- use the Site/discord server/upgrade as part of any effort to compete with us or otherwise use the Site/discord server/upgrade and/or the Content for any revenue-generating endeavor or commercial enterprise.
- decipher, decompile, disassemble, or reverse engineer any of the software comprising or in any way making up a part of the Site/discord server.
- attempt to bypass any measures of the Site/discord server/upgrade designed to prevent or restrict access to the Site/discord server/upgrade, or any portion of the Site/discord server.
- harass, annoy, intimidate, or threaten any of our moderator/employees or agents engaged in providing any portion of the Site to you.
- delete the copyright or other proprietary rights notice from any Content.
- upload or transmit (or attempt to upload or to transmit) viruses, Trojan horses, or other material, including excessive use of capital letters and spamming (continuous posting of repetitive text), that interferes with any party’s uninterrupted use and enjoyment of the Site or modifies, impairs, disrupts, alters, or interferes with the use, features, functions, operation, or maintenance of the Site/discord server/upgrade.
- disparage, tarnish, or otherwise harm, in our opinion, us and/or the Site.
- use the Site/discord server/upgrade in a manner inconsistent with any applicable laws or regulations.
4. SERVICES OR PRODUCTS GIVEN TO CUSTOMERS
Course material services to learn Technical Analysis to analyse cryptos markets. Upgrades (VIP, APPRENTICE) provide additional features (MOONCHARTS trading plans, analysis, courses, VIP chats, VIP market updates…). There is no financial advice for any content shared by MOONCHARTS.
5. PAYMENT TERMS, OPTIONS AND WHEN CUSTOMER IS OBLIGATED TO MAKE PAYMENTS
Payment can be made via Stripe (credit card), PayPal or by cryptocurrencies (BTC, BCH, LTC and DOGE). Customers can make payment once a month. You are responsible for managing your own subscription period. No refund possible.
6. WARRANTIES OR GUARANTEES THAT ARE OFFERED WITH THE PRODUCT OR SERVICES
There is no financial advice, you are responsible for your own trade, entries, exits and capital involved.
Any possible loss of money will be your own responsibility.
Any features change for upgrade can be made at any time.
7. DEADLINES FOR DELIVERING PRODUCTS OR SERVICES
The upgrade will be given to you immediately after the subscription. If you have any problems, private message @matheomc on discord or contact us at “support@mooncharts.fr”. Any maintenance time is announced in the #website-maintenance channel on the MOONCHARTS discord server.
8. WHAT WILL HAPPEN IF THE CUSTOMER DOESN’T PAY
If the customer does not pay or if the payment fails, the upgrade will be cancelled immediately after a few attempts.
9. COPYRIGHT
Paid Content published on the website or discord server « MOONCHARTS » from MOONCHARTS is to stay on it.
Any person that will share paid content will have their subscription cancelled without any refund and will be banned from the website and the discord server.
Every VIP content is to stay in the VIP section.
Every APPRENTICE content is to stay in APPRENTICE section.
10. COMMUNITY RULES
1. The server is international! To be able to communicate with each other, English language is mandatory.
2. No insults or disrespectful behavior! Zero tolerance towards toxicity and harming self/others.
3. No sensitive or violent content accepted here ! Do not post any NSFW content.
4. Do not spam.
5. No advertising is allowed here. This also extends to discord DMs. Using the discord server or the website to gain subscribers and followers in any way will not be tolerated.
6. The Moderators and admin reserve the right to ban or kick anyone that they feel is here only to troll and disrupt the community regardless of the other rules.
7. The server is moderated by @Matheo , @maj7sus2, @elPaulio and @Everesti.
8. If there is a difference of opinion, the mods will make the final decision.
9. @Matheo (MOONCHARTS) is not your personal analyst.
10. All questions for @Matheo must be asked on the discord server except if you are @VIP. Please do not spam @Matheo.
11. Do not promote irresponsible investment behaviors, especially when talking to less experienced people. Here we try to educate each other so we all can learn to trade wisely.
12. Every TA have to be posted in community-ta channels to keep other chats clean. Please do not criticise others TA if you don't know 100% rules. Speak calmly and explain things (e.g this is not possible imo because of this....this... / i would place it more like that because of ..... / We got the invalidation because of ..... so your waves are not possible). Keep the community helpful and respectful !
13. By entering our trading community, you acknowledge all the community rules above.
MOONCHARTS reserves the right to change/add/delete any or all rules at any time without consent or notice. Any violation of these rules leads to warning, mute, kick or ban.
